Settlement of Civil Disputes

A service provided by Dubai Courts to present disputes between parties to a competent authority to resolve them amicably in an easy manner in terms of procedures, time and cost, with aim to spare the parties from resorting to the judiciary through endorsing the reconciliation agreement and make it a legally enforceable document. However in case the reconciliation is not possible, the dispute shall be presented to the supervising judge to finalize  it either with a ruling of resolving the dispute, or to refer it to the competent court.

This is a service provided by Dubai Courts to present disputes between the parties (Civil, Commercial, Real Estate or Personal Status) before the competent authority in order resolve them amicably and in through simple procedures quickly and cost effectively without resorting to litigation

Conditions
- The value of the financial claim must not exceed AED 500,000. - None of the parties to the dispute must be a bank, or a finance company. - Preparing a dispute draft that includes (the name of the disputing and the disputed party, their addresses in detail, mentioning the facts, the value of the financial claim, with specifying the final claims). - Preparing a Folder including (identity proof of parties - a trade license for companies and establishments - financial obligations supportive documents between the parties). - Translating documents into Arabic legally authenticated by the Ministry of Justice in UAE, and if the documents are issued from outside the UAE, they must be attested by the official authorities: e.g. the Ministry of Foreign Affairs in the concerned country, the Embassy of UAE in the concerned country, and the Ministry of Foreign Affairs and International Cooperation in UAE.
Fees
- A petition to resolve a dispute of a specified value: A fee of AED 250 shall be paid at the time of registering a dispute of financial claims of a specified value. This fee will be refunded if the parties to the dispute reach to a settlement agreement.If the settlement was not possible, a fee of 6% of the claim value shall be paid, as a minimum of AED 500 and not more than AED 20,000. - Request for appointment of an expert  It is considered among unspecified value claims; therefore, a fee of AED 12001 will be collected. - A request to endorse the settlement agreement and endorse it with executive writ free of any charges. - Request for a common asset division dispute A fee of (1%) of disputing applicant share value in the joint share, shall be collected to  a maximum limit of AED 40,000.
