Specialization

This Court has jurisdiction over the suits filed by employees against their natural or legal employers in private sectors concerning their rights resulting from labor ties by virtue of their individual labor contracts approved by concerned Ministry, as well as it views counter suits filed by employers in these cases. This court has two circuits, the minor circuits, which consist of a single judge to view the labor cases of a value less than one hundred thousand Dirham as well as counter cases regardless of their value. The second one is the major circuits which consist of three Judges presided by one of them who would look the labor claims of more than one hundred thousand Dirham as well as the counter cases regardless of their value.

Labor cases of full jurisdiction

Labor cases offull jurisdiction are cases introduced by workers against their employers in the private sector in order to protect their rights emanating from the labor relationship by vertue of labor contracts supervised by the concerned ministry, whenever their value is in excess of 100000 Dirham.
Concerned Department:The court of full jurisdiction with due observance of the rules of jurisdiction and conflict of laws in the Procedural Law and the Law on Civil transactions.
Formation of Department:Three judges+Clerk of session (Secretary)
Charges:5% of claims and causes of action. Not collected upon filing ths suit due to the exemotion of workers in compliance with article 5 of the Law organizing Labor relations.
Insertion and Interference:Relevant with due observance of the procedural rules and the law on fees.
Occasional Applications:Relevant with due observance of the procedural rules and the law on fees.

Labor cases of summary jurisdiction are cases introduced by workers against their employers in the private sector to protect their rights emanating from the labor relationship by virtue of labor contracts supervised by the concerned ministry, whenever their value does not exceed 100000 Dirham.
