Court's jurisdiction

The jurisdictions of Execution Court constitutes the type, it consists of bench of competent judges who are exclusively assigned by the legislator to execute the execution writ; which are as follows:

  • Judgments and orders.
  • Documents certified as per the law organizing the certification and legalization process.
  • Conciliation Minutes approved by the Courts.
  • Other documents holding similar capacity by the virtue of law.

The Governing Articles:

The legislator has defined the third chapter of the Civil Procedures Code for execution of judgments, which includes definition of the execution judge and the execution procedures. While the second section stipulates Attachments, the Second Chapter stipulates the Provisional Attachment, the Third Chapter stipulates attachment the debtors belongings with a third party, the Fourth chapter stipulates the attachment of movables with debtor, Chapter Five stipulates attachment of shares, documents, and income, where Chapter Six stipulates the rules of attachment and sale of property.

The execution court consists of group of circuits, each circuit is presided by a specialized judge:

  • To examine all types of execution cases (civil, commercial, real estate, labour, Personal status )

  • Execution Judge to pass orders and decisions in execution files

  • On duty routine orders Judge to take decision in application for urgent matters of all sorts of cases (civil, commercial, real estate, labour, Personal status).

  • On duty urgent matter Judge to examine online and take decision in application for urgent and precautionary procedures of all sorts of cases (civil, commercial, real estate, labour, Personal status )

  • Injunction Judge to examine and adjudicate injunctions against execution of orders issued in temporary and subjective matters of all sorts of cases (civil, commercial, real estate, labour, Personal status ) except excluded by law otherwise.

  • Execution of judgement issued from judicial authorities outside of Dubai Court Jurisdiction.

  • Judicial Deputation from other Courts of UAE.

  • Execution of Foreign Judgement and International Arbitration Central decision in accordance with International Treaties signed by UAE bilaterally, collectively or reciprocally.
